Well, let’s start by saying that I don’t know much about the 14th Amendment or anything about politics or legal stuff in general. But if we consider the claim that Trump violated the 14th Amendment, then it might be worth examining what the 14th Amendment says and whether or not Trump fits the criteria outlined in Section Three.
According to the National Constitution Center, Section Three of the 14th Amendment states that “No person shall…hold any office…under the United States” if they have previously taken an oath to support the Constitution, violated that oath, and engaged in insurrection or rebellion against the United States.
Now, considering Trump’s role in inciting the Capitol riots on January 6th, 2021, one could argue that he did engage in insurrection by encouraging his supporters to challenge the results of the election, leading to violence and a direct threat to the safety of lawmakers inside the Capitol building.
However, determining whether or not Trump has been disqualified from holding future office would ultimately fall on Congress, which would need to vote to enforce Section Three of the 14th Amendment against him. As of now, there doesn’t seem to be much interest in pursuing such action, with some politicians even arguing that the 14th Amendment does not apply to Trump’s case.
So while there may be arguments for and against Trump’s potential disqualification, it would ultimately depend on how Congress chooses to interpret and enforce this particular provision of the Constitution.
