In May 2022, John’s lawyer made an application for him to be deemed not criminally responsible by reason of mental disorder.
Court heard that on the afternoon of May 20, 2016, 26-year-old John snuck in to Descoteau’s Nanaimo basement, armed with a gun and knife.
“He surreptitiously entered Mr. Descoteau’s basement suite from the backyard of the house, with a knife and a gun.
“Neither the absence of a reality-based motive nor the inexplicable nature of what Mr. John did means that his mental disorder caused him to act and deprived him of the ability to engage in rational moral reasoning.
Review Board, that oversees people found not criminally responsible or unfit to stand trial, must decide within the next two months whether John will remain in custody or be given a conditional or full discharge.
